1. About Us

These Terms of Service govern your use of the GetVisible website (getvisible.ie) and the services provided by Bizmark AI Ltd, a company registered in Ireland, trading as GetVisible.

2. Services

GetVisible provides digital visibility services to Irish businesses, including:

• Google Business Profile (GBP) management and optimisation
• Automated review request systems via SMS and email
• AI chat bot deployment and configuration on client websites
• Answer Engine Optimisation (AEO) content creation
• Monthly visibility reporting

The specific services provided to each client are defined in the service plan selected at sign-up (Starter, Growth, or Pro). GetVisible reserves the right to modify, update, or discontinue any service with reasonable notice.

3. Eligibility

Our services are intended for businesses operating in Ireland. By engaging our services, you confirm that:

• You are at least 18 years of age
• You have authority to enter into this agreement on behalf of your business
• The information you provide is accurate and complete

4. Fees and Payment

4.1 Pricing

Current pricing is published on our website. Fees are quoted in euros (€) and exclusive of VAT where applicable. A one-time setup fee is charged upon commencement of services. Monthly fees are billed in advance on the same date each month.

4.2 Payment terms

Payment is due within 7 days of invoice. We accept payment by bank transfer or debit/credit card. Overdue accounts may result in suspension of services after 14 days' notice.

4.3 Price changes

We will provide at least 30 days' written notice of any price increases. Continued use of services after that date constitutes acceptance of the new pricing.

5. Term and Cancellation

5.1 Month-to-month

All plans are provided on a rolling monthly basis. There are no minimum contract terms or lock-in periods.

5.2 Cancellation by client

You may cancel your subscription at any time by providing 30 days' written notice to support@getvisible.ie. Services will continue until the end of the notice period. Setup fees are non-refundable.

5.3 Cancellation by GetVisible

We reserve the right to terminate services with 30 days' notice. In cases of material breach of these terms (including non-payment or misuse), we may terminate immediately.

6. 90-Day Performance Guarantee

GetVisible offers a 90-day performance guarantee on all plans. If your practice does not receive at least 10 new patient enquiries within the first 90 days of service, we will continue to provide services at no charge until that threshold is met. This guarantee applies under the following conditions:

• The client has provided timely access to their Google Business Profile and website as requested
• The client has responded to our onboarding requests within 5 business days
• The client has not made material changes to their GBP or website that conflict with our work without prior notice
• The guarantee applies to total enquiries across all channels managed by GetVisible (GBP messages, AI bot captures, review-driven calls)

The guarantee does not apply where underperformance is due to factors outside our control, including but not limited to: significant market disruptions, Google algorithm changes affecting all local results, or client-side changes to the practice.

7. Client Obligations

To enable us to deliver our services effectively, you agree to:

• Provide timely access to your Google Business Profile, website backend, and any other required accounts
• Respond to onboarding requests and information requests within 5 business days
• Notify us promptly of any changes to your practice, services, hours, or contact details
• Not make conflicting changes to your GBP or website without notifying us in advance
• Ensure that all information provided to us is accurate and up to date

8. Intellectual Property

All content, reports, templates, and tools created by GetVisible remain the intellectual property of Bizmark AI Ltd unless otherwise agreed in writing. Upon full payment, clients are granted a non-exclusive licence to use content created specifically for their practice.

Clients retain ownership of their Google Business Profile, website, and any accounts that existed prior to engagement with GetVisible.

9. Confidentiality

Both parties agree to treat as confidential any non-public information shared during the course of the engagement. This obligation survives termination of the agreement.

10. Limitation of Liability

To the fullest extent permitted by Irish law, GetVisible's total liability to you for any claim arising from these terms or our services shall not exceed the total fees paid by you in the three months preceding the claim.

We are not liable for:

• Indirect, consequential, or loss of profit damages
• Changes to Google's algorithms, policies, or ranking systems
• Third-party platform outages or policy changes (including Google, Make.com, or chatbot providers)
• Loss of data caused by circumstances beyond our reasonable control

11. Disclaimer of Warranties

While we aim to deliver measurable results, digital marketing outcomes cannot be guaranteed beyond those stated in our 90-day performance guarantee. Search rankings, review volumes, and enquiry rates are influenced by many factors outside our control. We make no warranties beyond those expressly stated in these terms.

12. Third-Party Services

Our services may involve the use of third-party platforms including Google, Make.com, Tidio, Formspree, and others. Your use of these platforms is subject to their own terms of service. GetVisible is not responsible for changes to, or the performance of, third-party platforms.

13. Governing Law

These Terms of Service are governed by the laws of Ireland. Any disputes arising shall be subject to the exclusive jurisdiction of the Irish courts.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify active clients of material changes by email with at least 14 days' notice. Continued use of services following notice constitutes acceptance of the updated terms.
